Understanding Thailand Work Permit Requirements
In Thailand, all foreigners intending to work must obtain a work permit before starting employment. The permit is required for any activity involving physical or intellectual labor, regardless of whether it is paid or unpaid.
Key considerations for obtaining a Thailand work permit include:
- Application Process
The Ministry of Labor issues work permits. According to Section 8 of the Foreign Business Act, an employer can apply for a work permit on behalf of the foreign employee. However, the permit is issued only after the foreigner enters Thailand and completes the required in-person process.
- Visa Prerequisite
A work permit is granted only to individuals holding a non-immigrant B visa. Employers are responsible for supporting prospective employees’ visa application processes.
- Specific to Employer and Role
A work permit is tied to a specific company, position, and job role. It does not permit employment outside the designated employer or scope of work.
- Validity and Renewal
Initial work permits are valid for the non-immigrant B visa (typically 90 days). Once issued, the visa and work permit can be extended for up to one year and renewed annually.
